Terms & Conditions

These Terms & Conditions apply to your use of the CarBayz Automotive website, the CarBayz Customer Account, CarBayz mobile applications and customer-facing APIs, and to the vehicle services we provide, including selling your vehicle to CarBayz, buying a vehicle from CarBayz, bookings, test drives, inspections, offers, payments and refunds, agreements, delivery and handover, and ownership-transfer support.

They are written in plain English wherever possible. They do not replace the specific documents signed for an individual transaction.

• CarBayz — CarBayz Automotive, operating as CARBAYZ, the provider of the services described in these Terms.
• Customer / User — a person who uses the platform, creates an account, submits an enquiry, or enters into a transaction with CarBayz.
• Vehicle — the motor vehicle that is the subject of an enquiry, inspection, offer or transaction.
• BUY Transaction — a transaction in which CarBayz buys a vehicle from a customer.
• SELL Transaction — a transaction in which CarBayz sells a vehicle to a customer.
• Case — the record CarBayz uses to track a single transaction from enquiry through to completion.
• Booking — a reservation of a vehicle, recorded against a Case and subject to the applicable booking terms.
• Services — the platform, the customer account and the vehicle-related services CarBayz provides.
• Agreement — the purchase or sale agreement and related transaction documents executed for a specific transaction.

By using the platform, creating an account, submitting an enquiry or request, making a booking, or entering into a transaction, you agree to these Terms and to the transaction-specific documents that apply to you.

Where a signed Agreement or statutory transaction document covers a matter differently for a specific transaction, that document governs that transaction to the extent of the difference. These Terms do not override or amend an executed agreement.

• you must have the legal capacity to enter into the relevant transaction
• the information you provide must be accurate and current
• where you are selling a vehicle, you must have the right and authority to sell it
• you must comply with applicable law
• you must not impersonate another person or act without authority

You are responsible for access to your account and the devices you use to sign in. CarBayz may use a WhatsApp one-time code to verify your mobile number and authenticate your account.

• never share a one-time code, password or account access with anyone
• tell us promptly if you believe your account has been used without your permission
• we may temporarily restrict access where we reasonably suspect misuse or a security risk
• CarBayz staff and administrator accounts are separate from customer accounts and are not part of customer authentication

When CarBayz buys a vehicle from you, the process may involve:

• your enquiry or sell request
• review of vehicle documents
• a physical inspection
• an offer from CarBayz
• KYC and ownership verification
• a purchase agreement
• handover and transfer documentation
• settlement of the agreed amount
• intake of the vehicle into CarBayz inventory

An enquiry, a valuation or an inspection does not by itself guarantee that CarBayz will purchase the vehicle. A purchase depends on verification, the vehicle's condition, clear ownership, complete documents, an agreed price and executed transaction documentation, together with any other applicable requirement.

When you buy a vehicle from CarBayz, the process may involve:

• your enquiry
• vehicle selection and a test drive
• negotiation
• a booking
• KYC and transfer preparation
• a sale agreement
• payment
• delivery
• ownership transfer

Vehicle availability can change until a vehicle is properly reserved or sold under the CarBayz process. Listing a vehicle on the website is an invitation to enquire, not a binding offer to sell.

CarBayz aims to present accurate vehicle information, which may include specifications, inspection findings, photographs, odometer and condition information, and registration or insurance details.

Descriptive content is prepared in good faith but cannot be guaranteed to be free of every error or omission. Material representations for a transaction are governed by the actual inspection record, the Agreement and the transaction documents, not by a website listing alone.

An inspection records the condition observed at the time it is carried out, within the scope of that inspection. Vehicle condition can change with use and time, and an inspection is not a promise of future mechanical performance. Any specific warranty exists only where it is expressly provided in a separate warranty or transaction document.

For a BUY transaction, an offer may depend on inspection findings, documentation, ownership status and the condition of the vehicle, and may be revised if those change.

For a SELL transaction, a listed or asking price may differ from the final negotiated price. In every case, the contractual price is the amount confirmed in the applicable transaction record and Agreement. A website display does not override signed transaction terms.

Booking amounts, the reservation period, cancellation and any refund or forfeiture are governed by the booking and cancellation terms disclosed to you at the time of booking and by the applicable transaction record. These Terms do not set a universal booking amount or a fixed cancellation penalty; the current approved CarBayz policy applies.

• payments must be made only through payment methods and accounts authorised by CarBayz
• never pay into a personal account presented as a CarBayz account — ask us to confirm first
• a payment is treated as complete when it is verified and posted to the transaction record
• CarBayz may carry out verification before recognising a payment
• keep your payment reference, as it may be required for reconciliation

Refund eligibility depends on the state of the transaction, the applicable booking and cancellation terms, the payment actually received, and the applicable agreement or policy. Approved refunds are processed through the CarBayz refund workflow, which includes internal verification and approval before release. We do not promise instant refunds, and settlement timelines can also depend on banking systems outside our control.

A purchase agreement or sale agreement may govern the contractual terms of your specific transaction. These general Terms do not replace a signed agreement, statutory transfer documents, payment receipts, or handover and delivery records.

Possession, handover or delivery of a vehicle takes place according to the transaction process and only once the required completion conditions have been met. The exact condition, location and timing depend on the applicable transaction and are recorded in the handover or delivery record.

Transfer of ownership may require your cooperation, original documents, signatures, and processing by government or RTO systems that operate on their own timelines.

CarBayz may facilitate or support the transfer where applicable, but cannot guarantee government processing times or outcomes. You must provide accurate information and required documents promptly so the transfer can proceed.

Parts of the service may involve third parties such as payment providers, inspection or support vendors, finance or insurance parties, government and RTO systems, and logistics providers. Independent third parties operate under their own terms, and CarBayz is not responsible for their independent acts beyond what applicable law or our contract with you requires.

You must not:

• provide false or forged KYC or identity information
• misrepresent ownership of a vehicle
• tamper with vehicle information, odometer readings or documents
• submit forged or altered documents
• attempt to take over another person's account
• abuse the one-time code or verification process
• attack, overload or probe CarBayz APIs
• scrape restricted data from the platform
• commit fraud or use the platform unlawfully

• fraud or attempted fraud
• impersonation of a customer, staff member or partner
• unauthorised access to any account, system or data
• uploading malware or harmful code
• automated abuse of APIs or authentication endpoints
• interference with the availability or integrity of the service
• misuse of customer or staff personal information
• any transaction that is unlawful under applicable law

CarBayz branding, software, website design, documents and proprietary content are protected by applicable intellectual property rights and may not be copied or reused without permission.

Content you submit — such as vehicle photographs and documents — remains yours. You grant CarBayz only the rights needed to process, store and display it for the service you have requested and to meet our legal and record-keeping obligations. CarBayz does not claim ownership of your personal documents.

We may maintain, modify, secure, update or temporarily interrupt online services, including for planned maintenance or urgent security work. We do not promise uninterrupted or error-free availability. Your transaction records remain governed by the canonical CarBayz records and the applicable agreements, irrespective of temporary website availability.

We may restrict or suspend access to an account where reasonably necessary for security, suspected fraud, legal compliance, abuse of the service, or a material breach of these Terms. A suspension of platform access does not by itself cancel completed legal or financial obligations of either party.

Except where expressly provided in a transaction document or required by applicable law, the platform and its content are provided on an "as is" and "as available" basis. Nothing in these Terms excludes or limits any statutory consumer right that cannot lawfully be excluded or limited. Any specific vehicle warranty applies only where it is expressly and separately provided in writing.

To the maximum extent permitted by applicable law, CarBayz is not liable for indirect, incidental or consequential loss, or for loss of profit, opportunity or data, arising from use of the platform. Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. Your mandatory rights as a consumer are preserved.

Subject to applicable law, you agree to indemnify CarBayz against direct losses, claims and reasonable costs arising from your fraud, unlawful use of the platform, submission of false information or documents, misrepresentation of vehicle ownership, or material breach of these Terms.

Personal information is handled in accordance with our Privacy Policy. To request deletion of personal data, see our Data Deletion page.

We may send service communications through the channels you provide, including WhatsApp, email and phone, depending on the service and your preferences. Operational and authentication communications — such as verification codes, appointment reminders, refund updates and transaction completion notices — are distinct from promotional marketing and are not treated as marketing consent.

We may update these Terms as our services or legal obligations change. The version and Last Updated date at the top of this page will reflect the change, and material changes will be communicated appropriately. Updates apply going forward and do not rewrite agreements that have already been executed.

These Terms are governed by the laws of India. Subject to applicable law, the courts at Jodhpur, RAJASTHAN have jurisdiction over disputes arising from these Terms.
